2. Purpose

These General Terms and Conditions of Sale exclusively govern the sale of products offered on the website www.yalomaswim.com. Any order placed on the site implies full and complete acceptance of these Terms and Conditions by the customer.

3. Products

The products offered are swimwear and accessories. Each item is presented with its essential characteristics (photos, descriptions, size guide).
Yaloma Swim reserves the right to modify at any time the information displayed on the site, including prices, product availability, descriptions, or conditions of any special offer or sale.

4. Prices

Prices are indicated in euros (€), VAT not applicable (Article 293 B of the French CGI). Shipping costs are the responsibility of the customer and specified at the time of order. For deliveries outside the European Union, customs duties or local taxes may apply: these are the sole responsibility of the customer.

5. Orders

Orders are placed online via the website. Any order confirmation implies acceptance of these Terms and Conditions. An order confirmation will be sent by email.
Yaloma Swim reserves the right to refuse any abnormal order (large quantities, suspected fraud, etc.).

6. Payment

Accepted payment methods:

• Bank cards via Shopify Payments (Visa, MasterCard)

• PayPal and Apple Pay

Payments are secured (SSL protocol). All credit card information is encrypted and never stored by Yaloma Swim. All transfers made via the site are processed by dedicated third-party payment gateways (Shopify Payments, PayPal), ensuring customer protection.

The order is considered final only after payment validation.

⚠️ You must be at least 18 years old, or have parental consent, to make a purchase on Yaloma Swim.

7. Delivery

Delivery methods: Colissimo, Mondial Relay, UPS, and Chronopost.

Estimated delivery times:

• Standard delivery within mainland France: 2 to 5 business days

• Express delivery in France & Europe: 48 hours

• International delivery: 6 to 15 business days depending on the carrier

Shipping costs are the responsibility of the customer. For deliveries outside the EU, customs fees and taxes remain the responsibility of the customer.

8. Withdrawal and Returns

In accordance with the French Consumer Code, customers have 14 days after receiving their order to exercise their right of withdrawal, without needing to provide justification.

Return conditions:

• Products must be returned new, unworn, unwashed, unstained, undamaged, and odor-free.

• Hygiene protectors must remain intact.

• All original tags must be attached.

• The reusable embroidered pouch must also be returned.

⚠️ If these conditions are not met, no refund will be made.
⚠️ If the pouch is missing, a flat fee of €10 will be deducted.

Return costs are the responsibility of the customer. Refunds will be processed within a maximum of 30 days after receipt and inspection of the returned items.

9. Legal Guarantees

Yaloma Swim applies the legal guarantees of conformity (Articles L.217-4 and following of the French Consumer Code) and hidden defects (Articles 1641 and following of the French Civil Code).

In the event of a defective or non-compliant product, Yaloma Swim undertakes to replace or refund the customer, including return costs.

10. Customer Responsibility

Each customer is responsible for maintaining the confidentiality of account information. Any activity carried out with their account is their sole responsibility.

11. Seller Responsibility

Yaloma Swim cannot be held responsible in the event of:

• misuse or poor maintenance of the product,

• non-compliance with the legislation of the delivery country,

• force majeure or unforeseeable event caused by a third party.

12. Personal Data

The information collected (name, address, email, phone number, payment details) is used solely for processing orders and communicating with the customer. It is secured and never resold to third parties.

In accordance with French law “Informatique et Libertés,” customers have the right to access, rectify, and delete their data by writing to hello@yalomaswim.com.

13. Intellectual Property

All content on the site (texts, photos, logos, design, videos) is the exclusive property of Yaloma Swim or used with permission, and is protected by French and international intellectual property laws.

Any use, reproduction, distribution, or public display, even partial, is strictly prohibited without prior written authorization from Yaloma Swim.

14. Applicable Law and Jurisdiction

These Terms and Conditions are governed by French law. In the event of a dispute, only French courts will have jurisdiction.
